Timber Sales

Land primarily devoted to growing trees for long-term commercial timber production on land that can be economically and practically managed for such production, including certain Christmas trees, and that has long-term commercial significance. Generally, factors considered to determine whether forest land is primarily devoted to growing trees for long-term commercial timber production on land that can be economically and practically managed for such production are: (1) the proximity of the land to urban, suburban, and rural settlements; (2) surrounding parcel size and the compatibility and intensity of adjacent and nearby land uses; (3) long-term local economic conditions that affect the ability to manage for timber production; and (4) the availability of public facilities and services conducive to conversion of forest land to other uses.

Merchantable Timber

A stand of trees that will yield logs and/or fiber suitable in size and quality for the production of lumber, plywood, pulp or other forest products of sufficient value at least to cover all the costs of harvest and transportation to available markets.

Timber Deed

A document transferring to a buyer ownership of specific timber, either standing or down, located on specific real property. Money is usually exchanged upon execution of the Timber Deed.

Timber Sale Contract

A contract that makes a purchaser responsible for logging specific timber, located on specific real property, within a specific time. Money is usually exchanged after timber is logged and sold to market. Timber Sale Contracts may also include warranties, disclaimers, and create other legal relationships between the parties.

Log Sale Contract

A contract that makes a seller responsible for logging specific Timber and delivering the logs to the purchaser. Money is usually exchanged upon delivery. Log Sale Contracts may also include warranties, disclaimers, and create other legal relationship to the parties.

Logging Service Contract

A contract between an owner of Timber and an independent contractor hired by the owner to log and deliver specific timber to owner’s customer. Failure of owner to pay contract price may give rise to a logger’s lien.
